A) DETAILS IDENTIFYING
THE PORTAL OWNER
Welcome tour website. This warning and disclosure regulate the use
of the Internet website service www.stl.es (hereinafter the "Site")
property of SISTEMAS TÉCNICOS DE LOTERÍAS DEL ESTADO,
S.A.U. (hereinafter also STL), whose aim is to facilitate the public
in general with information concerning STL’s activity. We
ask you, please, to read the following information thoroughly prior
to using this website. The use of this digital publication and its
content is subject to said conditions of use. If you do not accept
the following terms and conditions, please abstain from using our
website and its contents. These general conditions are governed
by Spanish law.
B) GENERAL CONDITIONS OF USE OF THE PORTAL
The condition of User is acquired by accessing the Site. The user
is aware that access to and the use of the Site’s services
and contents are exclusively their own responsibility.
The expression “Site” shall be understood to include
–but not be restricted to- texts, graphs, images, animations,
musical creations, videos, sounds, drawings, photographs, computer
applications, databases, html code and other works included therein,
and, in general, all creations expressed by any medium or support,
either tangible or intangible, known of today or that may be invented
in the future, regardless of whether they are or not susceptible
to intellectual property in accordance with the Amended Text of
the Intellectual Property Act or any regulation that may supersede
it in the future.
Telephone access costs or any other type of expense incurred as
a result of connection when accessing the Site shall lie exclusively
with the user. The user shall only meet the following technical
conditions in order to be able to take advantage of using the Site:

C) USER’S RIGHTS AND OBLIGATIONS
The user may (i) get free access, with no need for previous authorization
to the contents and services of the Site available as such, notwithstanding
the special technical conditions, or the need for prior registration
with respect to specific services and contents, as determined in
these general conditions or in whichever special conditions that
may be duly published; (ii) use the services and contents available
exclusively for private use. The user may download a single copy
of the website for “off-line” visualisation for personal
and never commercial purposes, always respecting and including the
warnings and references of STL’s ownership and copyright;
(iii) make proper, lawful use of the site in accordance with current
legislation, ethics, morals and public order.
Under no circumstances may the user:

contravenes the general conditions of use and/or the special conditions
that govern the use of a certain service and/or content and may
prejudice or impair other users’ rights.
- Get access to or use the site’s services and contents for
purposes that are illicit, or for purposes that may violate the
rights and liberties of third persons, or which may prejudice, harm
or prevent in any way access to said contents and services, in detriment
to STL or third parties, or for the commission of illicit actions
or that contravene current legislation, ethics, morals and public
order.
- Use the services, either in whole or in part, to promote, sell,
contract, divulge personal or third party advertising or information
without STL’s prior authorisation.
- Include hyperlinks on private or corporate websites to this Site
that do not comply with the conditions established for such a purpose
and/or reproduce the Site either in whole or in part elsewhere on
n another website and without meeting the conditions foreseen for
said purpose.
- Perform any action that prevents or hinders users’ access
to the site, as well as the hyperlinks to the services and contents
offered by STL or by third parties through the Site and/or use any
type of computer virus, code, software, computer or telecommunications
programme, that may cause damage or unauthorised alterations to
the contents, programmes or systems accessible via the services
and contents rendered on the Site or in the information systems,
files and computer equipment of their users; or unauthorised access
to whichever contents and/or services of the Site.
- Eliminate or modify in any way the technical protection or identification
devices of STL or their legitimate owners that may have the contents
hosted on the web site or modify in any way the protection or identification
devices of STL, or the symbols which STL or legitimate third party
owners of the rights may incorporate in their creations that are
subject to intellectual or industrial property existing in this
Site.
- Include meta tags for brands, trade names or logos that are the
property of STL or third parties in web sites of their property
or for which they are responsible.
- Create and use frames on the Site that are accessible through
this site that conceal or modify – including but not limited
to these actions – contents, advertising spaces and brands
of STL or of third parties, regardless of whether or not they represent
acts of unfair competition or confusion
- Create frames in a web site of their responsibility or property,
that reproduce the home page and/or other pages accessible through
it, from the Site, without the prior consent of STL.
D) STL’S RIGHTS
STL, reserves the following rights:
- To modify the technical and other conditions of access to the
Site, unilaterally and without prior notice to users, notwithstanding
the contents of the Particular Conditions that may regulate the
use of a given service and/or content of the Site.
- To establish special conditions and, where applicable, the demand
for a payment or other requirements for accessing certain services
and/or contents.
- To limit, exclude or place conditions on user access in circumstances
under which there are not any full guarantees of a correct use of
the Site by users, in accordance with the obligations and prohibitions
accepted by them.
- To terminate the provision of a service or the supply of a content,
without being liable for indemnifications, when the said content
or service is illicit or contrary to the conditions established
for it, notwithstanding what is stated in the special conditions

If you wish to quote or use the Site as a reference and/or cite
a section or part of an electronic document, journal or other publication
that appears on this Site, it must be with the authorisation of
STL S.A.U.
F) EXEMPTION AND LIMITED LIABILITY OF STL
STL is exempt from any form of liability for damages of any kind
in the following cases:
- Due to the impossibility or difficulties in connecting to the
communications network through which this web Site is accessible,
regardless of the kind of connection used by the user..
- Due to the interruption, suspension or cancellation of access
to the Site, or due to availability or continuity of the functioning
of the Site and the services and/or contents of it, when this is
due to a cause that is beyond the control of STL, whether or not
this comes directly or indirectly from it.
- STL, accepts no liability for the availability or technical and
other conditions of access to the services and contents that may
be offered by third party suppliers of services, especially concerning
suppliers of information society services.
- STL shall at no time, assume liability for any damages that may
be caused by the information, contents, products and services –
including but not limited to these services - rendered, communicated,
hosted, transmitted, exhibited or offered by third parties to STL
- including information society service providers, through a Portal
that may be accessed by means of any link existing on this Site.
- For the processing and later use of personal data carried out
by third parties not connected with STL, or for the relevance of
the information requested by those third parties.
- For the quality and speed of access to the Site or the technical
conditions the user must satisfy, in order to access the Site and
its services and/or contents.
- STL will not be liable for any delay or failure that may occur
in access to, or functioning of, the services and/or contents of
the Site that are due to a case of force majeure.
- The user of the Site shall respond personally for all damages
of any nature caused to STL, be it directly or indirectly, due to
the failure to comply with any of the obligations derived from these
general conditions or other regulations governing the use of this
Site.
G) INTELLECTUAL AND INDUSTRIAL PROPERTY
The user is aware that the contents and services offered over the
Site –including texts, graphs, images, animations, musical
creations, videos, sounds, drawings, photographs, all the site’s
comments, exhibitions, computer applications, databases, html code
– without this being an exhaustive list – are protected
by intellectual property laws. The author's copyright and the rights
to exploit this Site financially are the property of STL. As regards
the contents included in the Site, copyright and all economic exploitation
are the property of STL or when applicable, third parties, and in
both cases, are protected by current laws on intellectual property
in force.
The brands, trade names and logos or distinctive signs that appear
on the web site are the property of STL or of third party entities,
and are protected by the laws of industrial property currently in
force.
The provision of services and the publication of contents on the
Site do not under any circumstances imply the cession, renouncing
or transmission, wholly or in part, of the ownership of the corresponding
intellectual and industrial property rights.
No part of this Site may be reproduced, distributed, transmitted,
copied or communicated publicly, transformed, wholly or in part,
using any kind of system or method, electronic or mechanical (including
photocopying, recording or any kind of information retrieval and
storage system) via any support known today or that may be invented
in the future, without the consent of STL. The use, in any way or
form, of all or part of the contents of the Site is subject to the
need to apply for prior authorisation from STL and the acceptance
of the corresponding licence, except for cases concerning the recognised
rights of the user granted in these general conditions, or those
that may be established in any special conditions that STL may establish
to regulate the use of a certain service and/or contents offered

Under no circumstance may the user make any use of the services
and contents of the Site that is not exclusively personal, with
the exceptions that are established in these general conditions
of use for this Site, or in any special conditions that STL may
decide to establish to regulate the use of a given service and/or
content offered on this Site. This is except as indicated in the
present general conditions for the use of this Portal.
If a culpable or negligent action or omission, directly or indirectly
attributable to the web site user that originates a violation of
the intellectual and industrial property rights of STL, or of third
parties –whether or not they benefit from said action –
should cause damages, losses, joint obligations, expenses of any
kind, sanctions, coercive measures, fines and other financial sums
arising or deriving from any claim, suit, action or proceedings,
be they civil, penal or administrative, STL will be entitled to
take all and any kind of legal action against the user and associate
and to claim any indemnification – including, but not exclusively
limited to –moral damages, damages to its image, indirect
damages, loss of earnings, advertising costs or costs of any other
kind that may arise from the repair of said damages, the cost of
any sanctions or condemnatory sentences, interests on arrears, the
cost of financing any sums arising for the other party, legal costs
and the cost of legal defence in any process that may arise due
to the aforementioned causes for damages caused by their action
or omission, notwithstanding any other actions STL may be entitled
to take.
H) HYPERLINKS
Persons or entities wishing to make or making a hyperlink from a
website of another Internet portal to any of the pages on STL’s
Site shall met the following conditions:
- It shall not be permitted to reproduce either in part or wholly
any of the Site’s services or contents.
- No deep-links, nor IMG or image links shall be established, or
frames with the Site’s pages without STL’s express prior
authorisation.
- No false inexact or incorrect manifestation shall be included
concerning the pages of the Site nor on its services or contents.
- Barring those signs that form part of the "hyperlink",
the website on which it is established shall contain no brand, trade
name, establishment sign, denomination, logo, slogan or other distinctive
signs belonging to STL, without its express authorisation.
- Establishing the "hyperlink" shall not imply the existence
of any type of relationship between STL and the owner of the web
page or portal from which it is established.
- STL shall not be responsible for the contents or services made
available to the public on the web page or portal from which the
"hyperlink" is done, and neither for the information and
manifestations included thereon.
- Any "hyperlink" to STL’s Site shall be to its
home page or main pages of the sections it contains.
I) LINKS
STL shall not be responsible for the information contained on web
pages belonging to third parties connected by links to STL’s
Site or which are not directly managed by our Site administrator.
The links that appear on this Site are purely for informational
purposes and under no circumstances shall they mean a suggestion,
invitation or recommendation to visit said sites.
J) PERSONAL DATA PROTECTION
SISTEMAS TÉCNICOS DE LOTERÍAS DEL ESTADO, S.A.U. (hereinafter
also STL) whose fiscal address is calle Manuel Tovar, 9, 28034 Madrid
(Spain), wishes to inform users of the Site at www.stl.es of its
policy concerning the processing and protection of the personal
data of users and clients acquired from them while they are viewing
the Site or using the services offered therein.
The collection of personal data, their processing and later use
are subject to the legislation currently in force in Spain concerning
data protection, established by the Personal Data Protection Act
(hereinafter the LOPD), Organic Law 15/1999 (December 13), and its
complementary regulations. STL will only be liable for, and will
only guarantee the confidentiality and security of the personal
data it receives from users through the Site accepting no form of
liability for the processing and later use of said personal data
by third parties. In particular STL implements data processing declared
before the Agencia Española de Protección de Datos
related to the activities derived from the Site. If the user does
not wish STL to process their personal data, we ask them please
to contact STL anonymously. The user may use pseudonyms or another
type of anonymous data though, if the user conveys personal data
to STL, said communication must be true and valid. In any case,
the user is prohibited from submitting data and/or using personal
data pertaining to other third persons.
Regarding personal data which STL may receive via e-mail from users,
the purpose of processing shall correspond to those of attending
to and handling the request made by the user at all times and the
maintenance of communications records.
STL warns the user that, if the user wishes to communicate personal
data to STL and is a minor and/or incapacitated, it shall be necessary
to have the consent of their parents, guardians or legal representatives
for the communication of their personal data, and hence STL requests
abstaining from using the e-mail service unless consent is forthcoming
from parents, guardians or legal representatives, STL otherwise
not being responsible for the actions of said minor or incapacitated
person.
The user may at any time exercise their rights to get access to,
rectify, cancel and oppose by writing to: STL, Manuel Tovar, 9,
28034-Madrid or to that address which may at any time replace it
as registered with the Spanish Data Protection General Registry
(Registro General de Protección de Datos. Exercising these
rights is a highly personal matter, and so only the user themselves
may exercise said rights regarding the personal data of which they
are the legitimate owner.
STL hereby informs that the exercise of said rights by a third party
who is not legally authorised by the user may involve the perpetration
of a criminal offence without prejudice to any other consequences
which may be forthcoming as a result of any civil or administrative
procedures that both the legitimate owner of the personal data and
the STL may have a right to exercise.
Recommendations to users
STL would remind users that Internet is not always as secure as
is expected, and thus recommends the user should use the latest
versions of computer programmes given that they include greater
security measures for the protection of the confidentiality and
integrity of your data to the extent to which they may require,
given that the risk exists that you may be impersonated or your

K) DURATION AND TERMINATION
Access to, and the contents and services offered on the site, will
in principle last indefinitely. STL, however, is authorised to terminate
or suspend access to the site, the services and/or contents thereof
at any time, notwithstanding the terms and conditions established
in the Special Conditions, when applicable. When reasonably possible,
STL shall previously warn as to the termination or suspension of
the rendering of Site and other services.
L) NULLIBILITY AND ANNULMENT
Should a given clause of these general conditions, or as the case
may be, of the particular conditions regulating the use of the given
service and/or content, be annulled or considered void, in whole
or in part, such annulment or nullibility shall not affect the validity
of any other clauses contained herein, which shall remain fully
effective and valid, except where the party alleging nullibility
or voidability can satisfactorily prove that without the clause
considered to be voidable or annullable the purpose of the present
Conditions can no longer be fulfilled.
M) LEGISLACIÓN APLICABLE Y JURISDICCIÓN
These general conditions are governed under the present general
conditions by Spanish Law and by the resolution of any disputes
related thereto at the Courts and Tribunals of the Capital city
of Madrid.
